Our hearts go out to the Malcolm family, and we are sympathetic to all the family has been through. We do not agree, however, with the jury verdict, and we intend to appeal to the Montana Supreme Court.

We are confident Evenflo will be exonerated of any liability on further consideration of the facts of the case and the proper application of the law.

Before going on the market our products are extensively tested to meet or exceed federal safety standards and are also tested by Evenflo and the National Highway Traffic Safety Administration while being sold.

Since the On My Way was last sold in 2002, we have added child restraint systems with new features and technologies to our product line. We will continue to be a leader in the child restraint industry and to provide customers with products that are proven to be safe.

Regardless of the circumstances, it is always a tragedy when a child dies, and we offer our condolences to the Malcolm family on their loss.
